Terms of Service

By accessing and using Shaflex ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

You must be at least 16 years of age to use the Service in compliance with the General Data Protection Regulation (GDPR), or the age of majority in your jurisdiction, whichever is greater. If you are between the ages of 16 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By creating an account or using the Service, you represent and warrant that you meet the eligibility requirements stated above. Shaflex reserves the right to request proof of age or parental consent at any time and to terminate accounts that do not meet these requirements.

Shaflex is a social media management platform that allows users to schedule, publish, and manage content across multiple social media platforms including but not limited to Twitter/X, Instagram, Facebook, LinkedIn, TikTok, and others. The service includes analytics, content creation tools, AI-assisted features, and team collaboration features.

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Post content that is harmful, offensive, or violates others' rights
• Engage in spam, phishing, or other malicious activities
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any commercial purposes without authorization

You retain full ownership of all content you create and upload to the Service. By using Shaflex, you grant us a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and transmit your content solely for the purpose of operating, maintaining, and providing the Service to you. This license terminates when you delete your content or your account, except where your content has been shared with other users and they have not deleted it.

All intellectual property rights in the Service, including software, design, and trademarks, remain the property of Shaflex or our licensors.

The Service may include AI-assisted features for content creation, including but not limited to text generation, caption suggestions, and post optimization. You are solely responsible for reviewing, editing, and approving any AI-generated content before it is published. Shaflex makes no guarantees regarding the accuracy, completeness, originality, or appropriateness of AI-generated content. You assume all liability for content published through your account, regardless of whether it was generated with the assistance of AI features.

By connecting your social media accounts to Shaflex, you authorize Shaflex to access and post content on your behalf to those platforms. You are solely responsible for ensuring that all content published through the Service complies with the terms of service, community guidelines, and policies of each respective social media platform.

Shaflex is not liable for any changes, outages, API modifications, or policy updates made by third-party social media platforms that may affect the functionality of the Service. Scheduled posts may fail or be delayed due to platform limitations, rate limits, authentication changes, or other factors beyond our control. Shaflex shall not be held responsible for any failed, delayed, or incorrectly published posts resulting from third-party platform issues.

The Service may offer team workspace features that allow multiple users to collaborate under a single account. The account owner is responsible for all activity conducted by team members within the workspace, including content created, published, or scheduled by team members.

The account owner controls team member permissions and access levels. It is the account owner's responsibility to manage permissions appropriately and to remove access for team members who should no longer have it. Shaflex is not liable for any unauthorized actions taken by team members within a workspace, including but not limited to unauthorized publishing, deletion of content, or misuse of connected social media accounts.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Service. By using Shaflex, you agree to the collection and use of information in accordance with our Privacy Policy.

Some features of the Service require payment. By subscribing to a paid plan:

• You agree to pay all applicable fees
• Billing is recurring unless cancelled
• We may change pricing with 30 days notice

Refund Policy: If you are not satisfied with a paid plan, you may request a full refund within 24 hours of your initial purchase or renewal. Refund requests made after 24 hours will not be honored. To request a refund, contact us at support@shaflex.com with your account email and the reason for your request.

You may cancel your subscription at any time and will retain access to paid features until the end of your current billing period. No refunds will be issued for partial billing periods outside the 24-hour window. After the billing period ends, your account will revert to the free tier, if available, or access to paid features will be discontinued.

While we strive to maintain high availability, we do not guarantee that the Service will be available at all times. The Service is provided without a Service Level Agreement (SLA). We may suspend or discontinue the Service for maintenance, updates, or other operational reasons, and we will endeavor to provide advance notice of planned maintenance windows when practicable.

Shaflex is not liable for any missed, failed, or delayed scheduled posts due to Service downtime, maintenance, or circumstances beyond our reasonable control. You acknowledge that reliance on scheduled posting features is at your own risk.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHAFLEX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

To the maximum extent permitted by law, Shaflex shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Shaflex, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) content you create, upload, or publish through the Service; (c) your violation of these Terms; (d) your violation of any third-party rights, including intellectual property rights; or (e) your violation of any third-party platform's terms of service or policies in connection with your use of the Service.

Shaflex may terminate your account for cause, including but not limited to breach of these Terms, with reasonable notice. In cases of serious or repeated violations, Shaflex reserves the right to immediately suspend or terminate your access to the Service without prior notice.

You may terminate your account at any time by using the account deletion feature in the Service or by contacting us. Upon termination, your right to use the Service will cease immediately, and any data associated with your account may be deleted in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Poland.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Shaflex regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, concerning the subject matter of these Terms.
